THE EMERGENCE OF NEW RIGHTS IN THE CONTEMPORARY CONTEXT

Abstract

This study's general objective is to analyze the emergence of new rights in the contemporary context, highlighting their origins, theoretical foundations, normative challenges, and prospects for implementation within the Brazilian legal system. However, it is understood that the study will employ a qualitative methodology characterized by exploratory and analytical elements. Initially, a literature review will be conducted, focusing on contemporary scholars in the fields of law and social sciences, with special emphasis on works addressing the theory of fundamental rights, legal sociology, and the concept of emerging rights. The Brazilian legal system has made significant progress in incorporating new rights through judicial decisions and legislation, but these advances have not always translated into effective access and protection for vulnerable groups. Law should be seen not only as an instrument of technical regulation but also as a means of promoting human dignity, inclusion, and social transformation. To transform legal guarantees into tangible realities, it is essential to strengthen democratic institutions, improve human rights education, and foster a legal culture attentive to society's needs, addressing issues of inequality, exclusion, and prejudice from a pluralistic and critical perspective. In conclusion, we affirm that emerging rights do not represent a transitory legal trend, but rather a valid manifestation of the transformations underway in today's society. These rights require attentive listening, thoughtful reflection, and decisive action from both the State and civil society. Promoting their realization transcends a mere legal duty; it embodies an ethical obligation to foster a more equitable, democratic, and compassionate nation, where every individual has the opportunity to live with freedom, dignity, and respect.
