Abstract
This paper aims to address the issue of probation, presenting it as a solution to the problems of the current Brazilian prison system, in a way that contributes significantly to the reduction of prison overcrowding. Although today it is configured as an essential right for those convicted who can enjoy the benefit, historically the conditional release has adapted to several changes. Furthermore, this article inserts conditional freedom to the reality of the country, as in the case of Elisa Samudio national repercussion, portraying the episode that occurred with former goalkeeper Bruno and his cronies. In addition, it is of paramount importance to connect conditional release to the current state of the world, experiencing the challenges and consequences of the Covid-19 pandemic.i
