THE INTELLECTUAL INQUIRY INTO LAW: ETHICAL AND POWER DYNAMICS IN MISS SLOANE AND CONSTITUTIONAL ADJUDICATION

Abstract

This abstract synthesizes an academic investigation into the intersection of Law, Literature, and Cinema, utilizing the film Miss Sloane as a laboratory to analyze the fragility of ethics within high-stakes strategic environments. The significance of this research lies in the urgent need to humanize legal practice in the face of algorithmic efficiency and the pragmatism of contemporary realpolitik. Adopting an interdisciplinary and analytical-critical methodology based on the Law and Literature movement, the abstract integrates the thought of Arnaldo Godoy and landmark cases from the Brazilian Supreme Federal Court—such as ADI 5735 and ADPF 54—to examine the “dialectical tension” within Brazilian constitutional adjudication. The conclusions point toward the urgency of an intellectual reform that prioritizes the “sentimental education” of the jurist, combating the objectification of Law and intellectual corruption. This analysis concludes by reaffirming that the improvement of institutions depends on the integration of impeccable technique and ethical humanism, ensuring that Law serves as a narrative of liberation and the protection of human dignity.
